By using kulist.com you agree to the following:
Earning Cash-Back for Your Purchases
In order to earn cash-back for your qualifying purchases you agree to the following criteria:
- You are at least 18 years of age
- You will create and maintain an account with kulist.com
- You will login to your account before making any purchases from our merchants
- You will use the links provided by kulist.com when linking to our merchants
- You must complete your purchases in accordance with the rules of our merchants
- You will not engage in any illegal activities such as (but not limited to) credit card fraud
- You must have cookies enabled on your browser
- You must reside in the U.S.A. or Canada
kulist.com receives commissions when you purchase from some or all of our merchants. Some of these merchants allow us to share this commission with you. As of June, 2006 we are NOT able to share our commissions for the following merchants:
- Amazon.com
- Bestprices.com
- Walmart.com
If other merchants inform us that we are not allowed to share our commissions we will update that information on this page. These changes may or may not be applied retroactively to previously earned cash-back.
kulist.com relies entirely on each merchants tracking and reporting mechanisms to determine when purchases are made. kulist.com is not responsible for tracking problems resulting from incorrect usage of the kulist.com site, disabling cookies, computer issues resulting from unknown causes such as third-party software or other issues, merchant partner errors/omissions or from any other failure of tracking mechanisms.
The commission that kulist.com receives from each merchant is normally calculated as a percentage of each products purchase price. Taxes, shipping, or other fees assigned by the merchant are typically not included in the commission calculation. Sometimes the use of coupons or rebates will invalidate the payment of a commission by the merchant. This is beyond the control of kulist.com.
kulist.com will only provide cash-back on purchases for which we receive a commission from the merchant. It is up to each merchant to establish the amount of commission that is paid to us.
kulist.com has chosen to share commissions earned with the purchaser. As of June, 2006 the sharing amount is 50% of whatever amount kulist.com has received when the above criteria have been met. This amount can be changed at our discretion and without notice but will be updated on this page accordingly.
Cash-back earned will be reported in your account as soon as it is made available to us by the merchant. Cash-back amounts will be held as Pending in your account until the merchants return/cancellation time periods have expired. Some merchants allow up to 120 days for returns or cancellations. Once the merchants return/cancellation period has been reached your Pending cash-back will be moved to a status of Available. When your cash-back Available reaches or exceeds $25 you will have the option to transfer that amount to your PayPal account or to request a Gift Certificate for one (1) of our selected merchants. It is your responsibility to transfer your balance as kulist.com does not provide an automated process. Additionally, it is your responsibility to protect your account from unauthorized access and for security purposes you will be required to verify your email address prior to executing any transfers.
Earning Cash-Back for Your Referrals
Programs to earn more cash-back may periodically be offered to users that create and maintain an active account. Participation is voluntary and if you choose to participate you agree to the following terms and any terms added here in the future:
- You will not engage in marketing techniques that involve unsolicited emails (or spam)
- You will not use the program to do self-referrals
- You will not engage in any illegal activities such as (but not limited to) credit card fraud
- Users that you refer to kulist.com are bound by all of the Terms and Conditions set forth herein
- Violating any of these terms will result in termination of your account
The "my friends" referral program is currently being offered. Here is how it works:
- You must join and activate your account
- Introduce your friends to kulist.com via email, your blog, or your website
- Instructions and links can be found in the "my friends" section of your account
- Your friends must join, activate, and use their own accounts
- 10% of our commission will be paid to you when your friends/referrals make qualifying purchases
- Each friends purchase/cash-back amounts is kept private
- You only see a summary total for all of your friends under your "my cash" section
Bonus Offerings
Bonus offerings may periodically be offered to new users or existing users. The following terms apply to any bonus amounts offered or earned:
- The maximum amount of bonus earnings per user is $10 every 12 months
- You can participate in multiple offerings provided the maximum allowable amount is not exceeded
- Bonus amounts will show in your account as Pending and will not be available for Transfer until the minimum tranfer amount is reached
- Only available to new users and duplicate accounts are prohibited
Data Reliability / Warranty
Information about prices and products is provided by third parties and is for informational purposes only. kulist.com does not represent or warrant the accuracy or reliability of the information, and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use.
Site Availability
kulist.com does not provide any guarantee for the availability of its services and will not be liable for any losses, injuries, or damages that could arise if the site becomes unreliable, unavailable, or is discontinued. kulist.com may also discontinue operation at any time with or without notice.
Amendments
The "Terms and Conditions" set forth within this agreement may change from time to time. kulist.com will post those changes on this page. You consent to be bound by all the said "Terms and Conditions," including any and all updates thereto. kulist.com will not be responsible if you do not learn of the modification. It is your responsibility to check this page of the kulist.com site regularly to determine whether this agreement has been modified. If you do not agree to any modification of this agreement, you must immediately terminate your account.
Compliance with Laws and Regulations
You agree to comply with all applicable laws, rules and regulations. You may participate in kulist.com if and to the extent that such participation is permitted by such laws, rules and regulations. kulist.com may refuse to enroll, restrict, modify or terminate your account without liability to you or any other third party if you violate any law, rule or regulation, of if your participation could violate any law, rule or regulation.
Termination of Agreement
(a) Any violation of the Terms and Conditions of this Agreement is grounds for termination of your account with kulist.com.
(b) kulist.com reserves the right to terminate your account if your account is inactive for twenty-four (24) consecutive months. An account shall be deemed and considered to be inactive if there has not been any kulist.com cash-back earning activity.
(c) You may terminate your account at any time by sending an email to our Customer Service.
(d) If your account with kulist.com is terminated for any reason, either by you or by kulist.com, you shall forfeit any and all earned kulist.com cash-back in your account.
(e) kulist.com reserves the right to terminate your account if your account has been associated with any legally questionable activity.
